1. The agreement

These terms are a contract between you and PocketCraft OÜ ("PocketCraft", "we", "us"), the company that publishes the Fax iPhone app. By downloading or using Fax you accept them. If you do not, please delete the app.

Your privacy is governed by our Privacy Policy, which forms part of these terms.

2. Your licence

We grant you a personal, revocable, non-exclusive and non-transferable licence to use Fax on Apple-branded devices that you own or control, in accordance with Apple's Usage Rules. The app is licensed, not sold. You may not copy it, rent it out, resell it, reverse-engineer it except to the extent the law says you may regardless of this clause, or strip out any notice of ownership.

3. What Fax does, and what it cannot promise

Fax prepares a document and asks a telecommunications carrier to deliver it to a telephone fax number. The carrier dials a number on the public telephone network, and that network behaves the way it has for forty years: lines are engaged, machines are switched off, paper runs out, numbers are reassigned, and some destinations refuse calls from overseas.

So we deliver on a best-effort basis. We do not guarantee that any particular fax will arrive, that it will arrive within any particular time, or that it will be legible at the other end. The app reports the outcome the carrier gives us, as accurately as it is given, and you can resend a failed fax. Where a fax fails, that is the remedy.

Do not use Fax for anything time-critical or safety-critical, and never to reach emergency services. Emergency numbers are not fax destinations and cannot be dialled from this app.

4. Your document, and your responsibility for it

The documents you send remain entirely yours. We claim no ownership of them. You grant us only the narrow permission we need to do the job: to store your document, convert it, pass it to our carrier, and deliver it to the number you chose.

By sending a fax you confirm all of the following:

5. Unsolicited faxes are prohibited

This deserves its own clause, because sending advertising by fax is specifically regulated almost everywhere, and the penalties fall on the sender.

You may not use Fax to send unsolicited commercial or advertising material. In the United States this is restricted by the Telephone Consumer Protection Act and the Junk Fax Prevention Act; across the European Union, fax marketing requires the recipient's prior consent. You may not send bulk faxes to numbers you harvested, bought or guessed, and you may not use the app to harass, threaten or repeatedly contact anyone who has asked you to stop.

We also prohibit using Fax to send anything unlawful, anything that infringes someone else's rights, anything that attempts to defraud or impersonate, any malware, or anything obtained by breaking into a system. Attempts to circumvent the page allowance, to automate the app, to probe our infrastructure, or to resell access to it are equally prohibited.

We may suspend or terminate your access immediately if you breach this clause, and we may hand whatever we hold to a regulator or a court if we are legally required to.

6. Page allowance

Your subscription includes a weekly page allowance. It exists so that no single user can exhaust the carrier capacity shared by everyone, and we may adjust it as capacity and demand change. If you reach the allowance the app will tell you, and sending pauses until your allowance next resets. Your documents, your history and your subscription are unaffected, and so is anything already sent. If you need a higher limit for genuine business use, write to us and we will discuss it.

7. Subscriptions, renewal and cancellation

Fax functions are sold as an auto-renewing subscription, available in weekly and yearly terms. The current price, period and any introductory offer are shown in the app before you confirm — those in-app figures are the binding ones, because prices differ by country and change over time.

Refunds are handled by Apple, not by us. We cannot issue, approve or refuse one. Request a refund at Apple's "Report a Problem" page or through your Apple Account. We will happily help you work out what happened, and we will answer any question Apple asks us.

Restoring purchases on a new device is done with the Restore button in the app's settings.

8. Changing or discontinuing the app

We improve Fax continuously, and we may add, change or remove features. If we ever discontinue the service altogether, we will give reasonable notice in the app and stop charging renewals.

9. Warranties

We provide Fax with reasonable care and skill. Beyond that, and to the fullest extent the law allows, the app is provided as it is: we do not warrant that it will be uninterrupted or error-free, that every fax will be delivered, or that it will suit a particular purpose of yours.

Nothing here removes the rights you have as a consumer under the law of the country you live in. If that law gives you a guarantee we cannot exclude, you keep it.

10. Liability

To the extent the law allows, we are not liable for indirect or consequential loss, for lost profit, business, contracts or goodwill, or for any loss arising from a fax that failed to arrive, arrived late, arrived in poor condition, or was sent to a number you entered incorrectly.

Where we are liable, our total liability for all claims in any twelve-month period is limited to the greater of the amount you paid us in that period or fifty euro.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.

11. Indemnity

If someone brings a claim against us because of a document you sent, a number you sent it to, or your breach of section 4 or section 5, you will cover the reasonable costs and damages we incur as a result, provided we tell you promptly and let you take part in the defence.

12. Ending the agreement

You may end it at any time by cancelling your subscription and deleting the app. We may end it, or suspend your access, if you breach these terms, if we are required to by law, or if we discontinue the service. Sections 4, 10, 11 and 13 survive.

13. Governing law and disputes

These terms are governed by the law of Estonia, and the courts of Estonia have jurisdiction.

If you are a consumer resident in the European Union, this does not deprive you of the protection of the mandatory consumer law of your own country, and you may bring proceedings in the courts there. Please write to us first — nearly everything is settled faster by email than by litigation.

14. Apple's position

Fax is distributed through the App Store, and Apple requires us to state the following. We agree with it.

15. Everything else

If a clause turns out to be unenforceable, the rest stands. Not enforcing a term on one occasion does not waive it. You may not transfer this agreement; we may transfer it as part of a sale or reorganisation of our business, without reducing your rights.

We may update these terms. The date at the top always shows the current version, and we will give notice in the app before a material change takes effect.
